Media interpretations of this pseudo-standoff between Poland and the EU suffer from unfamiliarity with the Communist modus operandi. The last time Poland had a rule of law was before WWII. The much-applauded changes of 1989-90, described as ‘collapse of Communism’, were merely a rebranding exercise. The same Communist class is ruling Poland, as before.
However, Poland does not have a legal system in the sense of western democracy. It is the same oppressive system as before. Foreigners don’t know it because they usually don’t interact with it and the media don’t report on the daily violations of law by the Polish state. They are not on the receiving end of the stick and continue to ignore realities. Poland is governed and regulated neither by the letter nor the spirit of the law, regardless of whether of EU origin or the one officially proclaimed in Poland.
The Charter of Fundamental Rights of the EU states
“Conscious of its spiritual and moral heritage, the Union is founded on the indivisible, universal values of human dignity, freedom, equality and solidarity; it is based on the principles of democracy and the rule of law. It places the individual at the heart of its activities, by establishing the citizenship of the Union and by creating an area of freedom, security and justice.”
The EU Charter then proceeds to declare in the First Article
“Human dignity is inviolable. It must be respected and protected”.
Human dignity is neither respected nor protected in Poland. The EU’s bureaucracy is not interested in protecting it. My wife and I sent several alarming letters with accompanying documents demonstrating an intense, brutal campaign against our family violating the most basic human and civic rights, and thus violating the EU Charter of Fundamental Rights. We made all top officials in Poland and hundreds of MPs fully aware of the extent of organized criminal activities against us. We also wrote to EuroMPs several times. There was no meaningful response from the EU. They did not ask for more information and were not interested in the mechanisms of organized criminal activities of the Polish state against us. So, we are formally citizens of the EU, but de facto we are not.
Polish authorities decided to take focus away from individual rights into mostly abstract and irrelevant (in Poland) purely performative area of constitutional declarations. The EU responds to this provocation exactly as predicted by the PL functionaries.
What is at stake is not the supremacy or not of the EU law in Poland, because the EU Charter of Fundamental Rights is routinely violated anyway. The aim of the ‘constitutional’ provocation is political and historical narrative control, the main tool in the hands of the political class in Poland. There is no comparable concept in western democracies.
My parents were prisoners of Communist concentration camps. The Polish authorities’ actions against our family speak volumes about the situation in Poland. This is the continuation of Communist repression. The West continues to believe that the most advanced form of dictatorship simply collapsed like a house of cards, However, the so-called ‘collapse of Communism’ was a staged spectacle.
Polish authorities fired my wife and me from our state jobs in 2015. My wife was accused of unspecified ‘delusions’ and prohibited from working as a piano teacher in Zielona Góra School of Music, the job she was performing very successfully for over twenty years. She was the best piano teacher among the group of nearly twenty. I was simultaneously fired from my job as an associate professor of physics at the Adam Mickiewicz University in Poznan. We both had the highest professional qualifications. I was the only faculty member with a western PhD (University of Florida). We were liquidated because we tried to do our jobs honestly, refused falsifications, and because my parents steadfastly resisted the Communist takeover.
